YOUR VACATION CONTRACT

Thank you for choosing United Vacations. To ensure that you understand the conditions of your particular vacation, please read the following Terms and Conditions.

GENERAL VACATION DETAILS
  • Prices shown are in U.S. dollars based on rates in effect at the time of printing and are subject to change without notice.
  • Peak travel period surcharge, minimum night stays and holiday blackouts may apply depending on your travel dates.
  • All hotel prices are per person based on double occupancy unless otherwise noted and are subject to change without notice.
  • It is recommended that you check in at the airport at least 2 1/2 hours prior to the scheduled flight departure and report to the gate at least 30 minutes before the flight departure. Failure to comply with these conditions may result in the loss of your seat to a stand-by passenger.
  • Airport/hotel transfers and unique features require the timely receipt of the complete passenger flight itinerary. If United Vacations does not have the complete flight itinerary prior to the issuance of travel documents, transfers and features, if purchased, will not be provided and there will be no refund for this unused service.
  • If this vacation is used for any reason other than leisure travel, some hotels may directly assess an additional surcharge during holiday, convention or special event time periods.
  • International travel including Canada, Mexico, Caribbean and Europe requires Proof of Citizenship. A valid passport is required for U.S. citizens traveling internationally. Please check with your consulate for visa travel requirements. Or information can also be found on the State Department’s Consular Website or the U.S. Department of Homeland Security’s website.

VACATION INCLUSIONS / EXCLUSIONS / SUBSTITUTIONS
Terms and Conditions, vacation prices, dates and features are subject to change at any time without notice in United Vacation’s sole discretion. Prices may not include airfare, gratuities, meals, handling fees, taxes or other government imposed fees and items of a personal nature unless otherwise noted. Special offers and value-added inclusions may be restricted, modified or withdrawn at any time. These promotional features have no cash value and are non-refundable if not provided or used. Prices may vary according to specific travel dates. All amenities shown for a particular property may not be available in every room category. United Vacations reserves the right, at any time, to substitute comparable alternate hotel accommodations, to alter or substitute vacation itineraries or to do both. Special room requests will be communicated to the applicable party but cannot be guaranteed.

AIR TRANSPORTATION
Airfares are based on the lowest applicable airfare available under the United Vacations program at the time of booking and are subject to change. United Vacations can guarantee your airfare only after receipt of full payment. Changes in flight itineraries after the issuance of tickets may result in increased airfare.

Airline Baggage Allowance: Two checked pieces are allowed (baggage fees may apply, see below for details). The maximum linear dimensions of either piece may not exceed 62 inches. Maximum weight of 50 lbs. per checked bag. One carry-on is allowed, maximum linear dimensions of 45 inches (9"H x 14"W x 22"L). Please note for air travel within international destinations, baggage allowances vary significantly with respect to size and weight restrictions. The number of carry-on pieces allowed may vary by airport or airline. Please consult your travel agent or contact your respective airport and airline prior to travel.

Customers who purchase an Economy ticket will be charged the following baggage fees:
• For travel within the United States including Hawaii as well as Canada, Puerto Rico and the U.S. Virgin Islands: $25 fee ($20 via EasyCheck-in®), per direction for the first checked bag. Also, a $35 fee ($30 via EasyCheck-in®), per direction will apply for a second checked bag.

• For travel from the U.S. to Mexico and the Caribbean Islands (excluding Puerto Rico and the U.S. Virgin Islands): $30 fee ($27 via EasyCheck-in®), per direction for the second checked bag.

• For travel from the U.S. to Europe: $50 fee ($45 via EasyCheck-in®), per direction for the second checked bag.

• Free checked bags may be allowed based on Mileage Plus status and/or the type of ticket purchased.

• Baggage policies may change at any time. Please see United Airlines Baggage Policy for additional information. United Vacations also offers flights via other airlines, these airlines may impose additional charges for checked baggage which is collected by the airline at check-in. Click here for a current list of airline baggage charges or contact the airline directly for current fees and policies.

Some air segments may be served by United’s code share partners, including Air Canada, Air Canada Jazz, bmi, Gulfstream-Continental Connection, IslandAir, Lufthansa, Austrian Airways, US Airways, US Airways Express, SAS, and others and/or United Express carriers Atlantic Coast, Chautauqua Airlines, Colgan Airlines, GO!, Go Jet, Hawaiian Air, Mesa, Shuttle America, SkyWest and Trans States.

Mileage Plus® members earn Mileage Plus® miles for the air portion of their vacation. Please specify your valid Mileage Plus® membership number at the time of booking or final payment. For any questions regarding your Mileage Plus® accrual call (800) 421-4655. You may also use your Mileage Plus® miles to upgrade the air seats purchased in conjunction with your United Vacations domestic vacation. To upgrade your ticket please contact United Airlines at (800) 241-6522, once you receive your documents. Upgrades are subject to availability and restrictions may apply.

PAYMENT
Prior to receipt of full payment, prices are subject to change without notice. Upon receipt of full payment, the prevailing vacation price will be guaranteed. However, United Vacations reserves the right to re-invoice your reservation at any time should an error be made in computing your vacation price. Once payment has been made, a $25 fee will be assessed to change forms of payment.

HOTEL TAXES AND SERVICE FEES
United Vacations markets hotels under a “prepaid/merchant” model, where we collect the full amount from you in advance and manage the payments to the hotel on your behalf. In connection with facilitating your hotel arrangement, the amount you are charged will include taxes and service fees. This amount includes an estimate to recover the amount United Vacations pays to the hotel related to your reservation for taxes owed by the hotel including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value added tax, good and services tax, and/or other similar taxes. The amount paid to the hotel in connection with your reservation for taxes may vary from the amount we estimate and include in the amount charged to you. The amount charged to you also includes an amount to compensate us for our services as well as covering costs we incur in connection with handling your reservation.

United Vacations is not the vendor collecting and remitting taxes to the applicable taxing authorities. Our hotel suppliers, as vendors, include all applicable taxes in the amount billed to us and we pay over such amounts directly to the vendors. United Vacations is not a co-vendor associated with the vendor with whom we book or reserve our customer’s travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes vary greatly by location.

CAR RENTAL REQUIREMENTS
Driver must be at least 25 years of age and in possession of a valid driver's license and a major credit card in their name. Car cost may not include drop charges, tolls, taxes, surcharges, upgrades, recoupment fees, airport fees and optional charges such as protection options and additional drivers. An underage fee will apply for drivers ages 21-24 years. Rental charges are based on each 24-hour period commencing at time of rental, with any additional hours subject to extra charge. A major credit card or a cash refundable deposit is required to protect against incidental charges and damages, payable directly to the car rental company. Car rental companies will not refund any unused portion of a voucher.

TRAVEL CANCELLATIONS AND REVISIONS
To avoid cancellation fees, we highly recommend purchasing United Vacations Trip Cancellation Waiver or “WorldCaresm Complete Coverage” plan. Cancellation is defined as a change to the departure date, a change in name (exceptions may be permitted for small corrections), a reduction to the number in the party, rebooking airfare, and/or the termination of the entire trip. All other changes to a reservation constitute a revision. All revisions are subject to availability. The following fees will apply in addition to any supplier or airline fees or penalties.

Published airfares are a non-refundable component of your vacation package and are not covered by pre-travel cancellation waivers. United Airlines published airfares that are canceled prior to travel may be re-booked towards a new published airfare packaged vacation within one year of the original ticketing date, travel may occur any time. If the published airfare purchased is other than a United Airlines airfare (such as with a codeshare partner), policies may vary and may be as strict as requiring travel and booking within one year of the original ticketing date. Restrictions apply.

REFUNDS
A written refund request (subject to the penalties herein) must be submitted to United Vacations no later than 90 days after the scheduled departure date or any payments and deposits shall be forfeited. Refund requests are subject to a minimum $25 administration fee. If documents have been issued, these must accompany any request for refund. Refunds are issued in the original form of payment received. No refunds will be made on unused or partially used hotel stays or features including but not limited to such items as theater passes, WALT DISNEY WORLD® Resort Tickets, sightseeing tours, Great British Heritage passes, and transfers. Ski lift tickets may be refundable if not used and returned in accordance with refund policies and will be evaluated on a case by case basis. No refunds will be made for unused portions of multi-day lift tickets.

RESPONSIBILITY
These vacations are planned and operated by United Vacations. United Vacations is acting as a tour operator and is responsible for arranging the services provided in these travel packages. All other suppliers providing transportation, sightseeing arrangements, optional tours and lodging accommodations for United Vacations, including United Airlines, are independent contractors and are not employees of United Vacations. All travel documents are issued subject to the terms and conditions specified by the suppliers.

Neither United Vacations nor its agent(s) shall be held liable for, and customer waives any claim against United Vacations and its agent(s) for any loss of or damage to property or injury to person caused by reason of any defect, negligence or other wrongful act or omission, of any other transportation company, lodging property, agency or any persons, including United Airlines, rendering any of the services included in the vacation package. In no event shall any party be liable for consequential damages. In the event the United Vacations services or accommodations cannot be provided due to delays or any other reason beyond the control of United Vacations, United Vacations will exercise all reasonable efforts to arrange alternative comparable services or accommodations. However, United Vacations will not be liable for, and customer hereby waives any claim against United Vacations, for any failure of performance by any other transportation company, lodging property, agency or any other third party providing services hereunder.

The liability of the airline for loss or damage to checked baggage shall be limited to not more than $3,300 per person for domestic flights. For international travels, including the domestic portions, subject to the Warsaw Convention, the liability limit for delay, damage or loss is approximately $9.07 per pound ($20.00 per kg) for checked baggage and approximately $400 per passenger for unchecked baggage. Where the Montreal Convention applies, the liability of the UA Carrier for the delay, damage or loss to checked and unchecked baggage is limited to 1,000 Special Drawing Rights per passenger. Please contact applicable carrier for details.

United Vacations reserves the right to decline, accept or retain any customer as a member of these vacations at any time. If a vacation is canceled by United Vacations, we shall have no responsibility beyond the refund of all monies paid by the customer to United Vacations. Tariffs and conditions herein are based on the lowest fare applicable at time of reservation and are subject to change. Customer will be responsible for all airport facility charges. Regular scheduled flights will be used; however, United Airlines does not guarantee any specific flight schedule and will not be responsible for lack of adequate connections, delays or changes of schedules. Flight patterns may not be altered to suit individual preferences. Any additional expenses incurred due to air scheduling will be the responsibility of the customer.

It is agreed by and between the passenger and the operator that all disputes and matters whatsoever arising under or in connection with or incident to the responsibility of United Vacations shall be litigated, if at all, in and before a court located in the state of Wisconsin, U.S.A., to the exclusion of the courts of any other state or country.

IMPORTANT NOTICE: The Mark Travel Corporation, its employees, officers, directors and shareholders (collectively, “United Vacations”) does not own, control or operate any hotel or any air, land or water transportation vehicles or companies of any kind, including without limitation, airplanes, helicopters, boats, rental cars, ground transportation vehicles, transport companies, shuttle services, buses, or local tour companies which may offer excursions or tours. United Vacations occasionally enters into contracts with hotels and air, land or water transportation companies, but all such entities are owned and operated by independent contractors. United Vacations is not responsible for any negligent or willful act, omission or failure to act on the part of any such entity or its employees, or of any other third party beyond its direct control. The United Vacations name and logo may appear on posted or hand-held signs at your hotel, at the airport of your departure or destination, in vans, buses, coaches or elsewhere during your vacation. This use of the United Vacations name and logo is solely intended to help you identify persons or entities who might provide services to you during your trip, but does not indicate, and should not be understood by you to indicate that United Vacations owns, controls or operates any entity displaying such a sign, or that United Vacations employs or controls any person holding or displaying such a sign.
